Applicant data protection

Diligence and transparency are the basis for a trusting working relationship. We therefore inform you about how we process your personal data as part of an application and how you can exercise your rights under the General Data Protection Regulation (GDPR) and the new German Federal Data Protection Act (BDSG).

Your application contains a lot of personal data, which we handle confidentially in order to protect your privacy. We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security procedures are regularly reviewed and adapted to technological progress.

You can apply to our company electronically via our applicant management tool or by e-mail. We will of course only use your details to process your application and will not pass them on to third parties. Please note that e-mails sent unencrypted are not protected against unauthorised access. When sending confidential documents and records, we recommend using encryption or sending them by post.

We process your personal data at your request to initiate an employment, training or study relationship. The legal basis is Art. 6 para. 1 a, b and f GDPR and Section 26 BDSG.

Further information on your rights as a data subject and on our information obligations in accordance with Article 13 GDPR can be found in the points below.

For applications by applicant management tool, email or questions about your application, we ask that you only use our general email address personal@heimathafenhotels.de for job vacancies in order to comply with the application process.

For what purposes do we process your data and on what legal basis?

We process personal data about you for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis for this is Section 26 (1) BDSG. Furthermore, we may process personal data about you insofar as this is necessary for the defence of legal claims asserted against us in the application process. The legal basis for this is Art. 6 para. 1 f GDPR; the legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

If we wish to store your personal data in order to consider you for future vacancies, we will obtain your consent in accordance with Art. 6 para. 1 a GDPR.

If there is an employment relationship between you and us, we may process the personal data already received from you for the purposes of the employment relationship in accordance with Section 26 (1) BDSG if this is necessary for the performance or termination of the employment relationship or for the exercise or fulfilment of the rights and obligations of the representation of employees' interests arising from a law or a collective agreement, a works or service agreement (collective agreement).

What are the sources of your data?

We process personal data about you for the purpose of your application for employment. We receive the data directly from you on the one hand and from job exchanges on which you have found our adverts on the other.

Who will your data be passed on to?

We may transfer your personal data to companies affiliated with us, insofar as this is permitted within the scope of the purposes and legal bases set out in section 3. Otherwise, personal data will be processed on our behalf on the basis of contracts in accordance with Art. 28 GDPR, in particular by host providers or providers of applicant management systems.

Is your data transferred to countries outside the European Union (so-called third countries)?

We do not transfer your personal data to countries outside the European Union.

How long will your data be stored?

We store your personal data for as long as is necessary to make a decision about your application. If an employment relationship between you and us does not materialise, we may continue to store data for as long as this is necessary for the defence against possible legal claims. In this case, the application documents will be deleted six months after notification of the rejection decision, unless longer storage is required due to legal disputes. If the storage is based on your consent, we will store your personal data until you withdraw your consent.

Your personal data will be deleted immediately after completion of the application process or after a maximum of 6 months, unless you have expressly given us your consent to store your data for a longer period or a contract has been concluded.

Does profiling take place?

We do not use profiling. Should there be any changes to this procedure, we will inform you separately about this and about your rights in this regard, insofar as this is required by law.

Is there an obligation to provide your personal data?

The provision of personal data is neither legally nor contractually required, nor are you obliged to provide the personal data. However, the provision of personal data is necessary for the conclusion of a contract of employment with us. This means that if you do not provide us with any personal data when applying, we will not enter into an employment relationship with you.

General rights

You have the right of access under Art. 15 GDPR, the right to rectification under Art. 16 GDPR, the right to erasure under Art. 17 GDPR, the right to restriction of processing under Art. 18 GDPR, the right to object under Art. 21 GDPR and the right to data portability under Art. 20 GDPR. The restrictions under Sections 34 and 35 BDSG apply to the right of access and the right to erasure. In addition, there is a right to lodge a complaint with a competent data protection supervisory authority in accordance with Art. 77 GDPR in conjunction with Section 19 BDSG.

You can withdraw your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us before the GDPR came into force, i.e. before 25 May 2018. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected. To exercise your rights, please contact us or our data protection officer.

Information about your right to object according to ART. 21 GDPR

Right to object in individual cases

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6(1)(e) GDPR (data processing in the public interest) and Article 6(1)(f) GDPR (data processing based on a balancing of interests).

If you lodge an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

Right to object to the processing of data for direct marketing purposes

In individual cases, we process your personal data for direct marketing purposes. You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising.
